How the Penalties Work

Two penalties,

one set of rules.

Who it applies to

Applicable Large Employers: generally 50 or more full-time and full-time equivalent employees, averaged over the prior year.

The “A” penalty

If coverage isn’t offered to at least 95% of full-time employees and one gets a Marketplace subsidy: $3,340 per full-time employee in 2026, minus the first 30.

The “B” penalty

If coverage isn’t affordable or lacks minimum value: $5,010 in 2026 for each full-time employee who gets a Marketplace subsidy.

Affordability in 2026

Employee cost for the lowest self-only plan can’t exceed 9.96% of income, measured using an IRS safe harbor.
